terms of service
by commissioning me you have agreed to everything stated below and understand these terms may vary slightly depending on the type of commission purchased.
I. GENERAL GUIDELINES:
I WILL NOT DRAW:
- Furries
- Mecha
- NSFW/Fetish content
- Hateful or political content
- Gore
- Sexualization of minors or incestuous material.
- I have the right to reject any drawing that I feel uncomfortable with or that I am unable to fulfill with my current skills.- If a client is rushing me or rude in any manner, I have the right to decline the request and/or give out a refund depending on completion of work.- Please have at least one reference picture ready for your commission. I cannot properly work with just written descriptions.- Clients are free to re-upload their commission to other platforms, but you must still credit me for the art. If posting to Instagram or Twitter, please tag me @mushibo_.- During the commission process, clients will receive WIP screenshots of their commission. I highly recommend notifying me of any changes you'd like made at this point in order to spare yourself possible late-stage revision fees later.- I will possibly post commission WIPs to my Twitter, but only if you chose the "free to post (including WIPs)" option on your commission request form. Otherwise, only the final work will be posted or nothing at all if a NDA agreement has already been established and paid for.- Any work started after the sketch is done only after client approval. Any revisions wished to be made past this point are subject to late-stage revision fees. You will then choose whether to pay the fee and have those revisions made, or stick with the un-revised version as the final piece for no upcharge. The monetary amount of the fee will vary based on the severity of the revision.- If there is no response or payment within 3 days of being contact by me, your spot will be forfeited. If paid, this policy will be dropped if you have previously notified me of your future absence.- If there is anything missing from your references that you'd like included in the final piece, please include a clear description or IRL/photo-bashed concepts of it in order to save both of our time and your money.- Clients must abide by the usage package chosen in the commission request form. Any commissions previously established as personal that are found in commercial use are subject to legal action.- Any work done or shared with the client must not be used for AI, NFTs, Machine Learning, or blockchain purposes. Such usage is strictly prohibited and will result in blacklisting for future commissions and possible legal action.
II. PAYMENT
- I only accept payment through the options offered by VGen. All prices are in USD.- Full payment prior to the start of the commission is strongly preferred, but a 50/50 method is also available. If the latter, only the sketch will be sent to you until the other half of the payment is sent. I will noy accept anything less than half of your total payment.- Major edits (such as but not limited to: recoloring, background changes, facial expressions, poses) requested after the initial sketch/coloring is approved will result in an additional fee that varies depending on complexity.- After your commission is accepted it will be added to my work queue here. You are also free to ask me yourself privately for more detail.- Tips are always appreciated but never required!
III. DEADLINES & refunds
- Commissions may take up to a month (30 days, though rare) depending on my workload and life circumstances. If your commission will be delayed I will make sure to notify you ASAP.- If you have a specified due date in mind you must let me know at least two weeks in advance. Failure to do so will result in rush fees. (If I am even able to complete it in that time.)- Unless a "Surprise Me!" commission, clients are free to request a refund at any point during the process, but understand that the amount of said refund will depend on work already put into the commission:
- Before initial sketch: I keep 5% of the current amount paid.
- Post initial sketch/WIP: Monetary value of the work put into the piece.
- Finalized piece: No refund.
IV. usage of art
- Your commission will not be used in any merchandise by me, but I do I reserve the rights of all artwork made to:
- Promote myself for advertising and professional purposes.
- Post on any form of social media I am on. (Unless previously agreed otherwise.)
- Use in my portfolio as an example to others, with a watermark attached.
- The client reserves the right to:
- Claim all rights to the character (In the case of OCs), but not the art itself.
- Share/Repost their artwork in any place they wish with proper credit to me.
- Request an NDA agreement from me.
any violation to the rules stated above can result in rejection any current and/or future commissions from said client.
